To enact section 6133.041 of the Revised Code to 1
authorize a joint board of county commissioners to 2
conduct proceedings regarding existing joint 3
county ditches via teleconference or video 4
conference. 5


       Section 1. That section 6133.041 of the Revised Code be 6
enacted to read as follows:7

       Sec. 6133.041. (A) Notwithstanding any other provision of 8
this chapter or Chapter 6131. of the Revised Code to the contrary, 9
a joint board of county commissioners, when practicable, may 10
conduct proceedings regarding existing improvements by video 11
conference or, if video conference is not available, by 12
teleconference. The joint board shall make provisions for public 13
attendance at any location involved in such a proceeding. The 14
participation of any commissioner or board of county commissioners 15
in a video conference or teleconference shall occur at the 16
location of the commissioners' main office or board room in an 17
open meeting at which the public is allowed to attend.18

        (B) Before convening a meeting of a joint board of county 19
commissioners by interactive video conference or by 20
teleconference, designated staff shall send, via electronic mail, 21
facsimile, or United States postal service, a copy of 22
meeting-related documents to each member of the joint board.23

        (C) The minutes of each joint county ditch meeting shall 24
specify who was attending by teleconference, who was attending by 25
video conference, and who was physically present. Any vote taken 26
in a meeting held by teleconference that is not unanimous shall be 27
recorded as a roll call vote.28

       (D) Nothing in section 121.22 of the Revised Code prohibits a 29
joint board of county commissioners from conducting a proceeding 30
in a manner authorized by this section.31
