To amend sections 4503.181 and 4511.68 of the Revised | 1 |
Code to allow certain motor-driven cycles and | 2 |
motor scooters to be parked on a sidewalk so long | 3 |
as the vehicles do not impede the normal flow of | 4 |
pedestrian traffic, and to revise the purposes for | 5 |
which a historical vehicle may be operated. | 6 |
Section 1. That sections 4503.181 and 4511.68 of the Revised | 7 |
Code be amended to read as follows: | 8 |
Sec. 4503.181. (A) As used in this section, "historical | 9 |
motor vehicle" means any motor vehicle that is more than | 10 |
twenty-five years old and that is owned solely as a collector's | 11 |
item and for participation in club activities, exhibitions, tours, | 12 |
parades, and similar uses | 13 |
vehicle shall not be used for general transportation, but may be | 14 |
operated on the public roads and highways to and from a location | 15 |
where maintenance is performed on the vehicle. | 16 |
(B) In lieu of the annual license tax levied in sections | 17 |
4503.02 and 4503.04 of the Revised Code, a license fee of ten | 18 |
dollars is levied on the operation of | 19 |
vehicle. | 20 |
(C) A person who owns | 21 |
applies for license plates under this section shall execute an | 22 |
affidavit that the vehicle for which plates are requested is owned | 23 |
and operated solely for the purposes enumerated in division (A) of | 24 |
this section, and also setting forth in the affidavit that the | 25 |
vehicle has been inspected and found safe to operate on the public | 26 |
roads and highways in the state. A person who owns | 27 |
motor vehicle and desires to display model year license plates on | 28 |
the vehicle as permitted by this section shall execute at the time | 29 |
of registration an affidavit setting forth that the model year | 30 |
license plates the person desires to display on the person's | 31 |
historical motor vehicle are legible and serviceable license | 32 |
plates that originally were issued by this state. No registration | 33 |
issued pursuant to this section need specify the weight of the | 34 |
vehicle. | 35 |
(D) A vehicle registered under this section may display | 36 |
historical vehicle license plates issued by the registrar of motor | 37 |
vehicles or model year license plates procured by the applicant. | 38 |
Historical vehicle license plates shall not bear a date, but shall | 39 |
bear the inscription "Historical Vehicle--Ohio" and the | 40 |
registration number, which shall be shown thereon. Model year | 41 |
license plates shall be legible and serviceable license plates | 42 |
issued by this state and inscribed with the date of the year | 43 |
corresponding to the model year when the vehicle was manufactured. | 44 |
Notwithstanding section 4503.21 of the Revised Code, only one | 45 |
model year license plate is required to be displayed on the rear | 46 |
of the historical motor vehicle at all times. The registration | 47 |
certificate and the historical vehicle license plates issued by | 48 |
the registrar shall be kept in the vehicle at all times the | 49 |
vehicle is operated on the public roads and highways in this | 50 |
state. | 51 |
Notwithstanding section 4503.21 of the Revised Code, the | 52 |
owner of | 53 |
military purposes and that is registered under this section may | 54 |
display the assigned registration number of the vehicle by | 55 |
painting the number on the front and rear of the vehicle. The | 56 |
number shall be painted, in accordance with the size and style | 57 |
specifications established for numerals and letters shown on | 58 |
license plates in section 4503.22 of the Revised Code, in a color | 59 |
that contrasts clearly with the color of the vehicle, and shall be | 60 |
legible and visible at all times. Upon application for | 61 |
registration under this section and payment of the license fee | 62 |
prescribed in division (B) of this section, the owner of such | 63 |
historical motor vehicle shall be issued historical vehicle | 64 |
license plates. The registration certificate and at least one such | 65 |
license plate shall be kept in the vehicle at all times the | 66 |
vehicle is operated on the public roads and highways in this | 67 |
state. If ownership of such a vehicle is transferred, the | 68 |
transferor shall surrender the historical vehicle license plates | 69 |
or transfer them to another historical motor vehicle the | 70 |
transferor owns, and remove or obliterate the registration numbers | 71 |
painted on the vehicle. | 72 |
(E) Historical vehicle and model year license plates are | 73 |
valid without renewal as long as the vehicle for which they were | 74 |
issued or procured is in existence. Historical vehicle plates are | 75 |
issued for the owner's use only for such vehicle unless later | 76 |
transferred to another historical motor vehicle owned by that | 77 |
person. In order to effect such a transfer, the owner of the | 78 |
historical motor vehicle that originally displayed the historical | 79 |
vehicle plates shall comply with division (C) of this section. In | 80 |
the event of a transfer of title, the transferor shall surrender | 81 |
historical vehicle license plates or transfer them to another | 82 |
historical motor vehicle owned by the transferor, but model year | 83 |
license plates may be retained by the transferor. The registrar | 84 |
may revoke license plates issued under this section, for cause | 85 |
shown and after hearing, for failure of the applicant to comply | 86 |
with this section. Upon revocation, historical vehicle license | 87 |
plates shall be surrendered; model year license plates may be | 88 |
retained, but no longer are valid for display on the vehicle. | 89 |
(F) The owner of | 90 |
historical vehicle license plates may replace them with model year | 91 |
license plates by surrendering the historical vehicle license | 92 |
plates and motor vehicle certificate of registration to the | 93 |
registrar. The owner, at the time of registration, shall execute | 94 |
an affidavit setting forth that the model year plates are legible | 95 |
and serviceable license plates that originally were issued by this | 96 |
state. Such an owner is required to pay the license fee prescribed | 97 |
by division (B) of this section, but the owner is not required to | 98 |
have the historical motor vehicle reinspected under division (C) | 99 |
of this section. | 100 |
A person who owns | 101 |
year license plates may replace them with historical vehicle | 102 |
license plates by surrendering the motor vehicle certificate of | 103 |
registration and applying for issuance of historical vehicle | 104 |
license plates. Such a person is required to pay the license fee | 105 |
prescribed by division (B) of this section, but the person is not | 106 |
required to have the historical motor vehicle reinspected under | 107 |
division (C) of this section. | 108 |
Sec. 4511.68. (A) No person shall stand or park a trackless | 109 |
trolley or vehicle, except when necessary to avoid conflict with | 110 |
other traffic or to comply with sections 4511.01 to 4511.78, | 111 |
4511.99, and 4513.01 to 4513.37 of the Revised Code, or while | 112 |
obeying the directions of a police officer or a traffic control | 113 |
device, in any of the following places: | 114 |
(1) On a sidewalk, except | 115 |
(B) of this section; | 116 |
(2) In front of a public or private driveway; | 117 |
(3) Within an intersection; | 118 |
(4) Within ten feet of a fire hydrant; | 119 |
(5) On a crosswalk; | 120 |
(6) Within twenty feet of a crosswalk at an intersection; | 121 |
(7) Within thirty feet of, and upon the approach to, any | 122 |
flashing beacon, stop sign, or traffic control device; | 123 |
(8) Between a safety zone and the adjacent curb or within | 124 |
thirty feet of points on the curb immediately opposite the ends of | 125 |
a safety zone, unless a different length is indicated by a traffic | 126 |
control device; | 127 |
(9) Within fifty feet of the nearest rail of a railroad | 128 |
crossing; | 129 |
(10) Within twenty feet of a driveway entrance to any fire | 130 |
station and, on the side of the street opposite the entrance to | 131 |
any fire station, within seventy-five feet of the entrance when it | 132 |
is properly posted with signs; | 133 |
(11) Alongside or opposite any street excavation or | 134 |
obstruction when such standing or parking would obstruct traffic; | 135 |
(12) Alongside any vehicle stopped or parked at the edge or | 136 |
curb of a street; | 137 |
(13) Upon any bridge or elevated structure upon a highway, or | 138 |
within a highway tunnel; | 139 |
(14) At any place where signs prohibit stopping; | 140 |
(15) Within one foot of another parked vehicle; | 141 |
(16) On the roadway portion of a freeway, expressway, or | 142 |
thruway. | 143 |
(B) A person shall be permitted, without charge or | 144 |
restriction, to stand or park on a sidewalk a motor-driven cycle | 145 |
or motor scooter that has an engine not larger than one hundred | 146 |
and fifty cubic centimeters, or a bicycle, provided that the | 147 |
motor-driven cycle, motor scooter, or bicycle does not impede the | 148 |
normal flow of pedestrian traffic. This division does not | 149 |
authorize any person to operate a vehicle in violation of section | 150 |
4511.711 of the Revised Code. | 151 |
(C) Except as otherwise provided in this division, whoever | 152 |
violates division (A) of this section is guilty of a minor | 153 |
misdemeanor. If, within one year of the offense, the offender | 154 |
previously has been convicted of or pleaded guilty to one | 155 |
predicate motor vehicle or traffic offense, whoever violates this | 156 |
section is guilty of a misdemeanor of the fourth degree. If, | 157 |
within one year of the offense, the offender previously has been | 158 |
convicted of two or more predicate motor vehicle or traffic | 159 |
offenses, whoever violates this section is guilty of a misdemeanor | 160 |
of the third degree. | 161 |
Section 2. That existing sections 4503.181 and 4511.68 of | 162 |
the Revised Code are hereby repealed. | 163 |
