A BILL
To amend section 4511.68 of the Revised Code to allow 1
certain motor-driven cycles and motor scooters to 2
be parked on a sidewalk so long as the vehicles do 3
not impede the normal flow of pedestrian traffic.4


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1.  That section 4511.68 of the Revised Code be 5
amended to read as follows:6

       Sec. 4511.68.  (A) No person shall stand or park a trackless 7
trolley or vehicle, except when necessary to avoid conflict with 8
other traffic or to comply with sections 4511.01 to 4511.78, 9
4511.99, and 4513.01 to 4513.37 of the Revised Code, or while 10
obeying the directions of a police officer or a traffic control 11
device, in any of the following places:12

       (1) On a sidewalk, except a bicycleas provided in division 13
(B) of this section;14

       (2) In front of a public or private driveway;15

       (3) Within an intersection;16

       (4) Within ten feet of a fire hydrant;17

       (5) On a crosswalk;18

       (6) Within twenty feet of a crosswalk at an intersection;19

       (7) Within thirty feet of, and upon the approach to, any 20
flashing beacon, stop sign, or traffic control device;21

       (8) Between a safety zone and the adjacent curb or within 22
thirty feet of points on the curb immediately opposite the ends of 23
a safety zone, unless a different length is indicated by a traffic 24
control device;25

       (9) Within fifty feet of the nearest rail of a railroad 26
crossing;27

       (10) Within twenty feet of a driveway entrance to any fire 28
station and, on the side of the street opposite the entrance to 29
any fire station, within seventy-five feet of the entrance when it 30
is properly posted with signs;31

       (11) Alongside or opposite any street excavation or 32
obstruction when such standing or parking would obstruct traffic;33

       (12) Alongside any vehicle stopped or parked at the edge or 34
curb of a street;35

       (13) Upon any bridge or elevated structure upon a highway, or 36
within a highway tunnel;37

       (14) At any place where signs prohibit stopping;38

       (15) Within one foot of another parked vehicle;39

       (16) On the roadway portion of a freeway, expressway, or 40
thruway.41

       (B) A person shall be permitted, without charge or 42
restriction, to stand or park on a sidewalk a motor-driven cycle 43
or motor scooter that has an engine not larger than one hundred 44
and fifty cubic centimeters, or a bicycle, provided that the 45
motor-driven cycle, motor scooter, or bicycle does not impede the 46
normal flow of pedestrian traffic. This division does not 47
authorize any person to operate a vehicle in violation of section 48
4511.711 of the Revised Code.49

       (C) Except as otherwise provided in this division, whoever 50
violates division (A) of this section is guilty of a minor 51
misdemeanor. If, within one year of the offense, the offender 52
previously has been convicted of or pleaded guilty to one 53
predicate motor vehicle or traffic offense, whoever violates this 54
section is guilty of a misdemeanor of the fourth degree. If, 55
within one year of the offense, the offender previously has been 56
convicted of two or more predicate motor vehicle or traffic 57
offenses, whoever violates this section is guilty of a misdemeanor 58
of the third degree.59

       Section 2.  That existing section 4511.68 of the Revised Code 60
is hereby repealed.61
