A BILL
To enact sections 3727.11, 3727.12, 3727.13, and 1
3727.14 of the Revised Code to provide for state 2
recognition of hospitals that are comprehensive 3
stroke centers, primary stroke centers, and acute 4
stroke ready hospitals.5


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. That sections 3727.11, 3727.12, 3727.13, and 6
3727.14 of the Revised Code be enacted to read as follows: 7

       Sec. 3727.11. (A) A hospital may apply to the department of 8
health to be designated as a comprehensive stroke center. 9
Application shall be made on a form furnished by the department.10

       (B) Not later than thirty days after receiving a completed 11
application, the department shall complete its review of the 12
application. If the department determines that the hospital has 13
provided sufficient evidence that the hospital is certified or 14
accredited as a comprehensive stroke center by either of the 15
following, the department shall designate the hospital as a 16
comprehensive stroke center:17

       (1) The joint commission;18

       (2) Another entity acceptable to the department that is 19
nationally recognized and provides certification or accreditation 20
of comprehensive stroke centers.21

       (C) A designation made under division (B) of this section 22
expires three years from the date it is made. A hospital may have 23
a designation renewed for subsequent three-year periods by 24
applying to the department on a form furnished by the department. 25
The department shall renew the designation if the hospital 26
continues to meet the requirements of division (B) of this 27
section.28

       (D) A hospital shall not use the phrase "comprehensive stroke 29
center" or otherwise hold itself out as a comprehensive stroke 30
center unless it is designated as a comprehensive stroke center 31
under this section.32

       (E) The department shall revoke a designation made under this 33
section if it determines that the hospital is no longer certified 34
or accredited as a comprehensive stroke center by an entity 35
specified in division (B) of this section.36

       (F) Annually, not later than the first day of December, the 37
department shall compile and make available a list of hospitals 38
designated as comprehensive stroke centers.39

       (G) This section does not limit the services that may be 40
provided by a hospital or prohibit a hospital from providing 41
services it is authorized to provide.42

       Sec. 3727.12.  (A) A hospital may apply to the department of 43
health to be designated as a primary stroke center. Application 44
shall be made on a form furnished by the department.45

       (B) Not later than thirty days after receiving a completed 46
application, the department shall complete its review of the 47
application. If the department determines that the hospital has 48
provided sufficient evidence that the hospital is certified or 49
accredited as a primary stroke center by either of the following, 50
the department shall designate the hospital as a primary stroke 51
center:52

       (1) The joint commission;53

       (2) Another entity acceptable to the department that is 54
nationally recognized and provides certification or accreditation 55
of primary stroke centers.56

       (C) A designation made under division (B) of this section 57
expires three years from the date it is made. A hospital may have 58
a designation renewed for subsequent three-year periods by 59
applying to the department on a form furnished by the department. 60
The department shall renew the designation if the hospital 61
continues to meet the requirements of division (B) of this 62
section.63

       (D) A hospital shall not use the phrase "primary stroke 64
center" or otherwise hold itself out as a primary stroke center 65
unless it is designated as a primary stroke center under this 66
section.67

       (E) The department shall revoke a designation made under this 68
section if it determines that the hospital is no longer certified 69
or accredited as a primary stroke center by an entity specified in 70
division (B) of this section.71

       (F) Annually, not later than the first day of December, the 72
department shall compile and make available a list of hospitals 73
designated as primary stroke centers.74

       (G) This section does not limit the services that may be 75
provided by a hospital or prohibit a hospital from providing 76
services it is authorized to provide.77

       Sec. 3727.13.  (A) A hospital may apply to the department of 78
health to be designated as an acute stroke ready hospital. 79
Application shall be made on a form furnished by the department.80

       (B) Not later than thirty days after receiving a completed 81
application, the department shall complete its review of the 82
application. If the department determines that the hospital has 83
provided sufficient evidence that it possesses all of the 84
following, the department shall designate the hospital as an acute 85
stroke ready hospital:86

       (1) A team of health care professionals, qualified to treat 87
acute strokes, that is available or on-call twenty-four hours a 88
day, seven days a week;89

       (2) Written stroke protocols that, at a minimum, cover the 90
following components: triage, stabilization of vital functions, 91
initial diagnostic tests, and medication use;92

       (3) A written plan and letter of cooperation with emergency 93
medical service personnel regarding triage and communication that 94
are consistent with regional patient care procedures;95

       (4) Emergency medical service personnel who are trained in 96
diagnosing and treating acute stroke;97

       (5) The capacity to complete basic laboratory tests, 98
electrocardiograms, and chest x-rays twenty-four hours a day, 99
seven days a week;100

       (6) The capacity to perform and interpret brain injury 101
imaging studies twenty-four hours a day, seven days a week;102

       (7) Written protocols, revised not less than once annually, 103
that detail available emergent therapies and reflect current 104
treatment guidelines and include performance measures;105

       (8) A neurosurgery coverage plan, call schedule, and triage 106
and transportation plan;107

       (9) Transfer protocols and agreements for stroke patients;108

       (10) A designated medical director with experience and 109
expertise in stroke care.110

       (C) A designation made under division (B) of this section 111
expires three years from the date it is made. A hospital may have 112
a designation renewed for subsequent three-year periods by 113
applying to the department on a form furnished by the department. 114
The department shall renew the designation if the hospital 115
continues to meet the requirements of division (B) of this 116
section.117

       (D) A hospital shall not use the phrase "acute stroke ready 118
hospital" or otherwise hold itself out as an acute stroke ready 119
hospital unless it is designated as an acute stroke ready hospital 120
under this section.121

       (E) The department shall revoke a designation made under this 122
section if the department determines that the hospital no longer 123
meets the requirements specified in division (B) of this section.124

       (F) Annually, not later than the first day of December, the 125
department shall compile and make available a list of hospitals 126
designated as acute stroke ready hospitals.127

       (G) This section does not limit the services that may be 128
provided by a hospital or prohibit a hospital from providing 129
services it is authorized to provide.130

       Sec. 3727.14.  A hospital shall not use the phrase "stroke 131
center" or "stroke hospital" unless one of the following is the 132
case:133

       (A) It has been designated as a comprehensive stroke center, 134
primary stroke center, or acute stroke ready hospital by the 135
department of health under section 3727.11, 3727.12, or 3727.13 of 136
the Revised Code;137

       (B) It has been certified or accredited as a comprehensive 138
stroke center or primary stroke center by the joint commission or 139
another entity acceptable to the department of health that is 140
nationally recognized and provides certification or accreditation 141
of comprehensive stroke centers or primary stroke centers.142
