A BILL
To permit school district boards of education to 1
excuse graduating twelfth-grade students from 2
attending school on make-up days that occur after 3
the scheduled high school graduation ceremonies 4
and to declare an emergency.5


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. (A) Notwithstanding anything to the contrary in 6
division (B) of the version of section 3317.01 of the Revised Code 7
in effect until July 1, 2014, in section 3321.01 or 3321.04 of the 8
Revised Code, or in any rule of the State Board of Education, for 9
the 2013-2014 school year only, a school district board of 10
education may excuse graduating twelfth-grade students from 11
attendance in school for any days or hours the students' schools 12
are open for instruction after the district's scheduled graduation 13
ceremony, as a result of adding days or hours to the school 14
calendar to make up days or hours the schools were closed that 15
school year for any of the reasons prescribed in division (B) of 16
the version of section 3317.01 of the Revised Code in effect until 17
July 1, 2014, in order to meet the required number of days of 18
instruction prescribed by the versions of sections 3313.48, 19
3313.481, and 3317.01 of the Revised Code in effect prior to July 20
1, 2014. A school district that excuses graduating twelfth-grade 21
students in accordance with this section shall not be considered 22
to have failed to comply with the versions of sections 3313.48, 23
3313.481, and 3317.01 of the Revised Code in effect prior to July 24
1, 2014.25

        (B) For the 2013-2014 school year, a school district may 26
excuse students in the twelfth grade from attendance in school for 27
any school day prior to the district's scheduled graduation 28
ceremony, only in accordance with division (B) of the version of 29
section 3317.01 of the Revised Code in effect prior to July 1, 30
2014, or the rules on excuses from school attendance adopted by 31
the State Board of Education, or if the students' schools are 32
closed to all students for days or during hours they are scheduled 33
to be open for instruction.34

       Section 2.  This act is hereby declared to be an emergency 35
measure necessary for the immediate preservation of the public 36
peace, health, and safety. The reason for such necessity lies in 37
the fact that immediate action is necessary to provide school 38
districts the authorization to excuse graduating students from 39
making up days missed in the current school year that occur after 40
the scheduled graduation ceremony due to the school district 41
exceeding the number of excused "calamity" school days permitted 42
by law. Therefore, this act shall go into immediate effect.43
