A CONCURRENT RESOLUTION

To express the General Assembly's support for the 1
commercial docket pilot project established by the 2
Supreme Court. 3

BE IT RESOLVED BY THE HOUSE OF REPRESENTATIVES OF THE STATE OF OHIO
(THE SENATE CONCURRING):

       WHEREAS, Commercial litigation is a complex and highly 4
specialized area of law that requires special expertise on the 5
part of judges as well as attorneys; and 6

       WHEREAS, Commercial litigation is often costly and 7
unpredictable, and many judges lack the knowledge and experience 8
needed to manage and decide commercial cases efficiently and 9
reliably; and 10

       WHEREAS, In 2008, the Supreme Court of Ohio adopted Temporary 11
Rules of Superintendence authorizing the Chief Justice to 12
designate up to five counties to participate in a pilot project 13
creating commercial dockets in the courts of common pleas in those 14
counties that are overseen by judges with expertise in commercial 15
litigation; and 16

       WHEREAS, The courts of common pleas of Cuyahoga, Franklin, 17
Hamilton, and Lucas counties have been participating successfully 18
in the pilot project, cases are being handled more expeditiously 19
and the law is being applied more consistently in those courts 20
than before the pilot project, and the pilot project has resulted 21
in a general benefit of the courts, businesses, and people of this 22
state; and 23

       WHEREAS, The development and utilization of special dockets 24
to address commercial issues gives existing and future businesses 25
located in Ohio more confidence that commercial issues will be 26
handled by experts in that area of law and will result in greater 27
certainty and stability for businesses; therefore be it 28

       RESOLVED, That the General Assembly endorses the commercial 29
docket pilot project and urges the Supreme Court to expand the 30
commercial docket program and to make it permanent upon completion 31
of the pilot project; and be it further 32

       RESOLVED, That the Clerk of the House of Representatives 33
transmit duly authenticated copies of this resolution to Chief 34
Justice Thomas J. Moyer and to the news media of Ohio. 35
