A JOINT RESOLUTION
Applying to the Congress of the United States 1
pursuant to Article V of the United States 2
Constitution to call a constitutional convention 3
for proposing amendments.4


BE IT RESOLVED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       WHEREAS, With each passing year, this nation becomes more 5
deeply in debt as its expenditures exceed available revenues; and6

       WHEREAS, Fiscal prudence requires that certain steps be taken 7
to control the growth of the budget and eliminate excessive 8
deficits; and9

       WHEREAS, Article V of the United States Constitution requires 10
the United States Congress to call a constitutional convention 11
upon the application of two-thirds of the legislatures of the 12
several states for the purpose of proposing amendments to the 13
United States Constitution; now therefore be it14

       RESOLVED, That the General Assembly of the State of Ohio, 15
pursuant to Article V of the United States Constitution, hereby 16
applies to the Congress to call a constitutional convention for 17
the purpose of proposing to the states for ratification an 18
amendment to the United States Constitution containing the 19
following provisions:20

       First, the amendment shall require the President to submit 21
and the Congress to adopt only balanced budgets for all federal 22
programs and agencies, except in times of war.23

       Second, the amendment shall grant the President the authority 24
to disapprove any item or items in any bill presented by the 25
Congress to the President in addition to the President's authority 26
to disapprove entire bills pursuant to Article I, Section 7 of the 27
United States Constitution. 28

       Third, the amendment shall require the President to submit 29
and the Congress to adopt budgets for all federal programs and 30
agencies on a biennial rather than annual basis; and be it further31

       RESOLVED, That this application constitutes a continuing 32
application in accordance with Article V of the United States 33
Constitution until at least two-thirds of the legislatures of the 34
several states have made application for a constitutional 35
convention or the Congress has proposed an amendment to the United 36
States Constitution equivalent to the amendment proposed in this 37
resolution; and be it further38

       RESOLVED, That, if the convention called by the Congress is 39
not limited in subject to the amendment proposed in this 40
resolution, any delegates, representatives, or participants from 41
the State of Ohio asked to participate in the convention are 42
permitted to debate and vote only on the proposed amendment 43
contained within this resolution or an equivalent amendment; and 44
be it further45

       RESOLVED, That if two-thirds of the legislatures of the 46
several states make application to the Congress to call a 47
constitutional convention, the State of Ohio requests that such a 48
convention be called not later than six months after the Congress 49
receives the thirty-fourth application from a state legislature; 50
and be it further51

       RESOLVED, That the Clerk of the Senate transmit duly 52
authenticated copies of this resolution to the Speaker and Clerk 53
of the United States House of Representatives, the President Pro 54
Tempore and Secretary of the United States Senate, the members of 55
the Ohio Congressional delegation, the presiding officer of each 56
house of each state legislature in the United States, and the news 57
media of Ohio.58
