A RESOLUTION

Permitting the Ohio Electoral College to conduct its 1
official vote for President and Vice-President of 2
the United States in the Senate Chamber on Monday, 3
December 17, 2012. 4

BE IT RESOLVED BY THE SENATE OF THE STATE OF OHIO:

       WHEREAS, The members of the Senate of the 129th General 5
Assembly of Ohio, in adopting this Resolution, permit the Ohio 6
Electoral College to use the Ohio Senate Chamber to conduct its 7
official vote for President and Vice-President of the United 8
States on Monday, December 17, 2012; and 9

       WHEREAS, The President and Vice-President of the United 10
States are the only federal elective officials not elected by a 11
direct vote of the people but are elected by an institution known 12
as the Electoral College; and 13

       WHEREAS, Article II Section 1 of the Constitution of the 14
United States provides that each state shall appoint a number of 15
electors equal to the whole number of Senators and Representatives 16
to which each state may be entitled in the Congress of the United 17
States; and 18

       WHEREAS, Article II Section 1 of the Constitution of the 19
United States provides that the electors shall meet in their 20
respective states and vote by ballot for the President and 21
Vice-President; and 22

       WHEREAS, Section 3505.39 of the Ohio Revised Code requires 23
the Ohio Secretary of State to select a place in the state capitol 24
for the electors to meet and cast their votes for the President 25
and Vice-President of the United States; and 26

       WHEREAS, The Ohio Secretary of State has requested the use of 27
the Chamber of the Ohio Senate for the Ohio members of the 28
Electoral College to meet and cast their votes for the President 29
and Vice-President of the United States on Monday, December 17, 30
2012; therefore be it 31

       RESOLVED, That we, the members of the Senate of the 129th 32
General Assembly of Ohio, in adopting this Resolution, permit the 33
Ohio Electoral College to utilize the Chamber of the Ohio Senate 34
on Monday, December 17, 2012, to conduct its official vote for 35
President and Vice-President of the United States, and we commend 36
its participants for their civic responsibility; and be it further 37

       RESOLVED, That the Clerk of the Senate transmit duly 38
authenticated copies of this resolution to the Ohio Secretary of 39
State and the Ohio Electoral College. 40
