A JOINT RESOLUTION
Applying for an Article V amendments convention. 1


BE IT RESOLVED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       The members of the 130th General Assembly of Ohio hereby 2
apply to Congress, under the provisions of Article V of the 3
Constitution of the United States, for the calling of a convention 4
of the states limited to proposing an amendment to the 5
Constitution of the United States requiring that in the absence of 6
a national emergency the total of all federal appropriations made 7
by the Congress for any fiscal year may not exceed the total of 8
all estimated federal revenues for that fiscal year, together with 9
any related and appropriate fiscal restraints; and be it further10

        RESOLVED, The Secretary of State is hereby directed to 11
transmit copies of this application to the President and Secretary 12
of the Senate and to the Speaker and Clerk of the House of 13
Representatives of the Congress, and copies to the members of the 14
said Senate and House of Representatives from Ohio; also to 15
transmit copies hereof to the presiding officers of each of the 16
legislative houses in the several states, requesting their 17
cooperation; and be it further18

       RESOLVED, This application is to be considered as covering 19
the balanced budget amendment language of the presently 20
outstanding balanced budget applications from other states, 21
including previously adopted applications from Alabama, Alaska, 22
Arkansas, Colorado, Delaware, Florida, Indiana, Iowa, Kansas, 23
Maryland, Mississippi, Missouri, Nebraska, Nevada, New Hampshire, 24
New Mexico, North Carolina, Pennsylvania, and Texas; and this 25
application shall be aggregated with same for the purpose of 26
attaining the two-thirds of states necessary to require the 27
calling of a convention for proposing a balanced budget amendment, 28
but shall not be aggregated with any applications on any other 29
subject; and be it further30

        RESOLVED, This application constitutes a continuing 31
application in accordance with Article V of the Constitution of 32
the United States until the legislatures of at least two-thirds of 33
the several states have made applications on the same subject. It 34
supersedes all previous applications by this legislature on the 35
same subject.36
