Proposing to enact Section 1h of Article II of the | 1 |
Constitution of the State of Ohio to authorize the | 2 |
General Assembly to invalidate rules proposed or | 3 |
adopted under a statute, and to create and empower | 4 |
one or more joint committees of the Senate and | 5 |
House of Representatives to review rules that have | 6 |
been proposed or adopted under a statute and to | 7 |
make recommendations to the General Assembly | 8 |
regarding those rules. | 9 |
Be it resolved by the General Assembly of the State of Ohio, | 10 |
three-fifths of the members elected to each house concurring | 11 |
herein, that there shall be submitted to the electors of the | 12 |
state, in the manner prescribed by law at the general election to | 13 |
be held on November 4, 2014, a proposal to enact Section 1h of | 14 |
Article II of the Constitution of the State of Ohio to read as | 15 |
follows: | 16 |
1h. The General Assembly, by concurrent resolution, | 17 |
may invalidate rules that have been proposed or adopted under a | 18 |
statute. | 19 |
The General Assembly may enact, and subsequently may amend or | 20 |
repeal, statutes creating and empowering one or more joint | 21 |
committees of the senate and house of representatives, in | 22 |
conformity with standards prescribed in the statute, to review | 23 |
rules that have been proposed or adopted under a statute and to | 24 |
make recommendations to the General Assembly with regard to those | 25 |
rules. Such a joint committee shall be comprised of an equal | 26 |
number of members from the senate and house of representatives, | 27 |
and may be assigned jurisdiction with regard to general or | 28 |
particular subjects. | 29 |

A statute enacted by the General Assembly that is currently | 31 |
in effect, but the validity of which is or may be questionable | 32 |
under the law as it existed before the adoption of Ohio | 33 |
Constitution, Article II, Section 1h, is ratified and entitled to | 34 |
continue in effect, but may be subsequently amended or repealed. | 35 |

If adopted by a majority of the electors voting on this | 37 |
proposal, Section 1h of Article II of the Constitution of the | 38 |
State of Ohio takes effect January 1, 2015. | 39 |
