A JOINT RESOLUTION
Urging the Congress of the United States to propose a 1
balanced budget amendment to the United States 2
Constitution and applying to the Congress, 3
pursuant to Article V of the United States 4
Constitution, to call a convention for proposing a 5
balanced budget amendment. 6


BE IT RESOLVED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       The General Assembly of the State of Ohio urges the Congress 7
of the United States to propose a balanced budget amendment to the 8
United States Constitution and hereby applies to the Congress, 9
under the provisions of Article V of the United States 10
Constitution, for the calling of a convention of the states 11
limited to proposing an amendment to the United States 12
Constitution requiring that in the absence of a national emergency 13
the total of all federal appropriations made by the Congress for 14
any fiscal year may not exceed the total of all estimated federal 15
revenues for that fiscal year, together with any related and 16
appropriate fiscal restraints; and17

       It is the intention of the General Assembly that matters 18
shall not be considered at the convention that do not pertain to 19
an amendment requiring that, in the absence of a national 20
emergency, the total of all federal appropriations made by the 21
Congress for any fiscal year may not exceed the total of all 22
estimated federal revenues for that fiscal year, together with any 23
related and appropriate fiscal restraints; and be it further24

        RESOLVED, The Secretary of State is hereby directed to 25
transmit copies of this application to the President and Secretary 26
of the Senate and to the Speaker and Clerk of the House of 27
Representatives of the Congress, and copies to the members of the 28
Senate and House of Representatives from the State of Ohio; also 29
to transmit copies of this application to the presiding officers 30
of each of the legislative houses of the several states, 31
requesting their cooperation; and be it further32

       RESOLVED, This application is to be considered as covering 33
the balanced budget amendment language of the presently 34
outstanding balanced budget applications from other states, 35
including previously adopted applications from Alabama, Alaska, 36
Arkansas, Colorado, Delaware, Florida, Indiana, Iowa, Kansas, 37
Maryland, Mississippi, Missouri, Nebraska, Nevada, New Hampshire, 38
New Mexico, North Carolina, Pennsylvania, and Texas. This 39
application shall be aggregated with those other applications for 40
the purpose of attaining the two-thirds of states necessary to 41
require the calling of a convention for proposing a balanced 42
budget amendment, but shall not be aggregated with any 43
applications on any other subject; and be it further44

       RESOLVED, If the convention called by the Congress is not 45
limited to considering a balanced budget amendment, then any 46
delegates, representatives, or participants from the State of Ohio 47
asked to participate in the convention are authorized to debate 48
and vote only on a proposed amendment or amendments to the United 49
States Constitution requiring that in the absence of a national 50
emergency the total of all federal appropriations made by the 51
Congress for any fiscal year may not exceed the total of all 52
estimated federal revenues for that fiscal year, together with any 53
related and appropriate fiscal restraints; and be it further54

        RESOLVED, This application constitutes a continuing 55
application in accordance with Article V of the United States 56
Constitution until the legislatures of at least two-thirds of the 57
several states have made applications on the same subject or the 58
Congress has proposed an amendment to the United States 59
Constitution equivalent to the amendment proposed in this 60
resolution. This application supersedes all previous applications 61
by the General Assembly of the State of Ohio on the same subject.62
