SENATORS OELSLAGER-BLESSING
A BILL
To authorize the conveyance of state-owned real estate in Stark County to
Leonard Cooper.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:
Section 1. The Governor is hereby authorized to execute a deed in the name
of the state conveying to Leonard Cooper, and his
successors and assigns, all of the state's right, title, and interest in the
following described real estate, together with any buildings, structures, and
other improvements located on the real estate:
Parcel #1
Known as and being Lot Number Six Thousand Fifty-three
(#6,053) in the City of Canton, Stark County, Ohio, as the same
appears upon the corrected schedule of the renumbering of lots in
said City.
Parcel #2
Situate in the City of Canton, County of Stark, and State
of Ohio: Known as and being part of Lot No. Six Thousand
Forty-eight (#6,048) in the City of Canton, Stark County, Ohio,
described as follows: Beginning at the Northeast corner of said
lot and running thence southwardly with the East line of said lot
and being also the west line of a 20 foot alley sixty-nine (69)
feet to the corner of a part of said lot heretofore conveyed to
Sarah Bucher; thence westwardly in a straight line to a point in
the East line of Cleveland Avenue 35 feet northwardly from the
southwest corner of said lot #6,048; thence Northwardly with the
East line of Cleveland Avenue 40 feet to the Northwest corner of
said lot and thence Northeastwardly to the Northeast corner of
said lot and place of beginning, together with and subject to a
driveway eight (8) feet in width, one-half of which is upon the
above described part of said lot, and the other half upon the
part of said lot adjoining the above described part of the south
said driveway beginning at the east line of said lot and running
westwardly with the south line of the part of said lot above
described 151.5 feet and which said driveway shall be maintained
for the joint use of the owner of the above described part of
said lot and the owner of the part adjoining the same as
aforesaid and their heirs and assigns forever; the grantee to
succeed to and assume all the rights and obligations concerning
said conveyance to Sarah M. Bucher recorded in Volume 377, page
352 of the Deed Records of said County.
Parcel #3
Situate in the City of Canton, County of Stark, and State of
Ohio and known as and being part of Lot No. 6,048 in said City.
Beginning at the Southwest corner of said Lot on North
Cleveland Avenue and facing 11th Street, N.W., and running thence
East with the South line of said Lot to the Southeast corner
thereof; thence Northerly with the East line of said Lot 87 feet;
thence Westerly in a straight line to a point in the West line of
said Lot 35 feet North of the Southwest corner thereof, and
thence Southerly with said West line 35 feet to the place of
beginning together with all improvements situate thereon;
together with and subject to a driveway eight feet in width,
one-half of which is upon the above described part of said Lot,
and the other half upon the part of said Lot on the North side of
the above described part; said driveway beginning at the North
East corner of the above described part of said Lot and running
thence Westerly with the North line thereof 151 5/10 feet, the
West 64 feet of which may be constructed of crushed stone or
paved with brick, each of the owners thereof to bear one-half of
the expenses thereof, and which driveway 151 5/10 feet in length
shall be maintained for the joint use of the owners thereof
respectively of the parts of said lot abutting thereon and their
heirs and assigns forever.
Excepting therefrom the following described real estate,
to-wit:
Situate in the City of Canton, County of Stark, and State of
Ohio, and known as and being part of Lot No. 6,048 in said City,
described as follows:
Beginning at the Southeast corner of said Lot; thence
Northwardly along the East line of said lot a distance of 15 feet
to an iron stake; thence Westwardly parallel to the South line of
said Lot a distance of 49.80 feet more or less to an iron stake
at the point of intersection of this course with the West line of
property of Irvin D. and Hazel P. Streb (part Lot No. 1,547) extended
Northwardly; thence Southwardly a distance of 13.91 feet more or
less to an iron stake at the Northwest corner of said Streb
property; thence Eastwardly along the South line of Lot No. 6,048
a distance of 55.4 feet more or less to the place of beginning
and containing 731 square feet of land, more or less.
The aforedescribed parcels being the same lands as described in Deeds to the
State of Ohio, of Record in Deed Volume 2757, Pages 193 and 195, Recorder's
Office, Stark County, Ohio.
Section 2. Consideration for the conveyance of the real estate described in
Section 1 of this act is a purchase price of two hundred thousand
dollars and no cents ($200,000).
Section 3. The proceeds of the conveyance of the real estate described in
Section 1
of this act shall be deposited into
the Building Consolidation Fund, which is hereby created in the state
treasury. At the
request of the Administrator of the Ohio Bureau of Employment Services, the
Treasurer of State shall transfer funds from the Building Consolidation Fund
to
the OBES Building Enhancement Fund, which is hereby created in the state
treasury. The
proceeds of the conveyance, less any amount deducted pursuant to this section
for the costs of the sale, shall be used to enhance other facilities owned by
the Ohio Bureau of Employment Services in which the United States Department
of
Labor has full equity. If any amount of the proceeds cannot be used for this
purpose, the Administrator shall return that usable portion of the proceeds,
less any amount deducted pursuant to this section for the costs of the sale,
to
the United States Department of Labor. An amount may be deducted from the
proceeds to cover the costs of the sale. The amount of the proceeds that is
deducted for that purpose shall be credited to the Unemployment
Compensation
Special Administrative Fund created under section 4141.11 of the Revised
Code.
Section 4. Upon payment of the purchase price by Leonard Cooper, the Auditor
of
State, with the assistance of the Attorney
General, shall prepare a deed to the real estate described in Section 1 of
this act. The deed shall state the
consideration. The deed shall be executed by the Governor in the name of the
state, countersigned by the Secretary of State, sealed with the Great Seal of
the State, presented in the Office of the Auditor of State for recording, and
delivered to Leonard Cooper. Leonard Cooper shall present the deed for
recording in the Office of the Stark County Recorder.
Section 5. Leonard Cooper shall pay the costs of the conveyance.
Section 6. This act shall expire one year after
its effective date.
