SENATOR KEARNS
A BILL
To authorize the conveyance of state-owned land in Greene County known
as the Ohio Veterans' Children's Home to Greene County and to repeal Section
139 of Am. Sub. H.B. 117 of the 121st General Assembly, which created Fund
4Z0, the Veterans' Plaza Fund, and provided that $1,000,000 of the proceeds of
the sale of the Ohio Veterans' Children's Home be deposited into that fund.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:
Section 1. (A) The Governor is hereby authorized to execute a deed in the
name of the state conveying to Greene County and its successors and assigns
all of the state's right, title, and interest in property located in Greene
County, consisting of approximately 368 acres and facilities thereon, known as
the Ohio Veterans' Children's Home. The Director of Administrative Services
shall prepare a legal description of this real estate. The Superintendent of
the Home shall review the legal description for its accuracy. When the
Superintendent is satisfied as to the accuracy, the Director shall deliver the
legal description to the Auditor of State for preparation of the deed.
(B) The conveyance shall be subject to any lease that the Director of
Administrative Services may negotiate with the Association of Ex-Pupils of the
Ohio Veterans' Children's Home, pursuant to division (E) of Section 166 of Am.
Sub. H.B. 117 of the 121st General Assembly.
(C) The consideration for the conveyance of the real estate described in
division (A) of this section is the mutual benefit accruing to the state and
to Greene County by having a single entity public property owner that would
develop programs to provide youth services on a portion of the property,
manage the development of the property, cooperate with social service agencies
in identifying uses and developing a comprehensive approach to serving the
citizens of the county and the state, and work with the Association of
Ex-Pupils of the Ohio Veterans' Children's Home to protect and expand its
interests related to certain facilities on the grounds.
(D) Within one year after the effective date of this section, the Auditor of
State, with the assistance of the Attorney General, shall prepare a deed to
the real estate described under division (A) of this section. The deed shall
state the consideration and shall state that the conveyance is subject to a
lease of properties as specified in division (E) of Section 166 of Am. Sub.
H.B. 117 of the 121st General Assembly to the Association of Ex-Pupils of the
Ohio Veterans' Children's Home. The deed shall be executed by the Governor in
the name of the state, countersigned by the Secretary of State, sealed with
the Great Seal of the State, presented in the Office of the Auditor of State
for recording, and delivered to the grantee. The grantee shall present the
deed for recording in the Office of the Greene County Recorder.
(E) This section expires two years after its effective date.
Section 2. That Section 139 of Am. Sub. H.B. 117 of the 121st General Assembly
is hereby repealed.
