A BILL
To authorize the conveyance of state-owned real estate located in Ottawa
County from the Ohio Department of Transportation to Paul Hemrick, Jr.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:
Section 1. The Governor is hereby authorized to execute a deed in the name of
the state conveying to Paul Hemrick, Jr., and his heirs and assigns, all
of the state's right, title, and interest in the following described real
estate:
A strip or parcel of land situated in Danbury Township, Ottawa County, State
of Ohio and known as being the west 360 feet of Lot Number Nineteen (19) in
Section Number Four (4), lying between the Southerly limited access right of
way of State Route 2 and State Route 296 connector and the Northerly right of
way line of County Road 135A and State Route 269, and being described as
follows:
Commencing at a PK Nail, said PK Nail being the Intersection of State Route
269 and County Road 135 and County Road 136;
thence South 78 degrees 06 minutes 50 seconds West, along the centerline of
State Route 269, 1168.48 feet to a point;
thence North 11 degrees 53 minutes 10 seconds West, 50 feet to a point on the
grantor's Easterly property line and being the Northerly existing right of way
line of State Route 269, same being 360 feet West of the West line of Lot
Nineteen (19), and the TRUE POINT OF BEGINNING;
thence South 78 degrees 06 minutes 50 seconds West, along the Northerly
existing right of way line 16.04 feet to a point;
thence continuing along the Northerly existing right of way line on a curve to
the right having a radius of 236.48 feet, a central angle of 43 degrees 45
minutes 00 seconds, on an arc distance of 180.57 feet, the chord bearing of
North 80 degrees 00 minutes 40 seconds West, a chord distance of 176.22 feet
to a point;
thence continuing along the Northerly existing right of way line of County
Road 135A North 58 degrees 08 minutes 10 seconds West, 206.16 feet to a point
on the grantor's Westerly property line, same being the West line of Lot
Nineteen (19);
thence North 01 degrees 45 minutes 25 seconds West, along the grantor's
Westerly property line, same being the Westerly line of Lot Nineteen (19) and
the Easterly line of a parcel of land owned by John J. Hunter, Trustee
recorded in Volume 344 Page 290, 371.56 feet to a point on the Southerly
existing limited access right of way line of the State Route 2 and State Route
269 connector;
thence North 73 degrees 45 minutes 20 seconds East, along the Southerly
existing limited access right of way line of the State Route 2 and State Route
269 connector, 371.82 feet to a point on the grantor's Easterly property line,
same being 360 feet West of the Westerly line of Lot Nineteen (19);
thence South 01 degrees 45 minutes 25 seconds East, parallel with the Westerly
line of Lot Nineteen (19), same being the Westerly line of a parcel of land
owned by Paul Hemrick Jr., ETAL, recorded in Volume 403 Page 912, 611.78 feet
to the point of beginning;
Containing 4.303 acre of land more or less.
This description was prepared from plans on file at the Ohio Department of
Transportation, District 2 Bowling Green, Ohio. Right of way plans of record
are OTT-2-22.60 and OTT 240 (0.07)(0.78)(267).
Bearings coincide with the Ohio Department of Transportation right of way plan
of record OTT-2-22.60.
This description was prepared by William Luce, Registered Surveyor No. 7297,
under the direction and supervision of Steven Wayne Hoffman Registered
Surveyor No. S-6821.
Grantor claims title by Volume 108, Page 463, recorded in Ottawa County's
Recorder's Office, Ottawa County, Ohio.
Section 2. Consideration for the conveyance of the real estate described in
Section 1 of this act is the purchase price of $6,900.
Section 3. Upon payment of the purchase price by Paul Hemrick, Jr., the
Auditor of State, with the assistance of the Attorney General, shall prepare a
deed to the real estate described in Section 1 of this act. The deed shall
state the consideration. The deed shall be executed by the Governor in the
name of the state, countersigned by the Secretary of State, sealed with the
Great Seal of the State, presented in the Office of the Auditor of State for
recording, and delivered to Paul Hemrick, Jr. Paul Hemrick, Jr., shall
present the deed for recording in the Office of the Ottawa County Recorder.
Section 4. Paul Hemrick, Jr., shall pay the costs of the conveyance.
Section 5. This act shall expire one year after its effective date.
