A BILL
To enact section 4731.227 of the Revised Code to permit physicians to use
alternative medical treatments if the risk of harm is
reasonable when
compared to the potential
benefit, the patient provides informed consent,
and the
treatment is
consistent with the standards enforced by the State Medical
Board.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:
Section 1. That section 4731.227 of the Revised Code be enacted to read as
follows:
Sec. 4731.227. AS USED IN THIS SECTION, "ALTERNATIVE
MEDICAL TREATMENT" MEANS A TREATMENT THAT DIFFERS FROM
TREATMENTS USED IN STANDARD OR PREVAILING APPROACHES IN
MEDICINE BUT IS REASONABLE WHEN ITS POTENTIAL BENEFITS ARE COMPARED TO THE
RISK OF HARM.
AN INDIVIDUAL AUTHORIZED TO PRACTICE MEDICINE AND SURGERY OR OSTEOPATHIC
MEDICINE AND SURGERY MAY USE ALTERNATIVE MEDICAL TREATMENTS IF THE PATIENT
PROVIDES INFORMED CONSENT AND THE TREATMENT IS CONSISTENT WITH SECTION 4731.22
of the Revised Code.
