To permit payment in fiscal year 2002 to school
districts that exceed the number of permitted
"calamity" days in fiscal year 2001 as a result of
closing schools to prevent the spread of
meningococcal disease, and to declare an
Be it enacted by the General Assembly of the State of Ohio:
SECTION 1. Notwithstanding section 3317.01 of the Revised
Code, no school district shall be denied payments under Chapter
3317. of the Revised Code for fiscal year 2002 if any school in
the district was open for instruction during fiscal year 2001 for
fewer days than required by sections 3313.48, 3313.481, and
3317.01 of the Revised Code, provided that the reason any such
school was not open for the required number of days was to prevent
the spread of meningococcal disease.
SECTION 2. This act is hereby declared to be an emergency
measure necessary for the immediate preservation of the public
peace, health, and safety. The reason for the necessity is that
immediate action is necessary to avoid delays in fiscal year 2002
payments to school districts that exceeded the number of permitted
calamity days in fiscal year 2001 because of an unforeseen need to
close schools to prevent the spread of meningococcal disease.
Therefore, this act shall go into immediate effect.
