"calamity" days in fiscal year 2001 as a result of

closing schools to prevent the spread of

meningococcal disease, and to declare an

emergency.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

Section 1. Notwithstanding section 3317.01 of the Revised	7
Code, no school district shall be denied payments under Chapter	8
3317. of the Revised Code for fiscal year 2002 if any school in	9
the district was open for instruction during fiscal year 2001 for	10
fewer days than required by sections 3313.48, 3313.481, and	11
3317.01 of the Revised Code, provided that the reason any such	12
school was not open for the required number of days was to prevent	13
the spread of meningococcal disease.	14

Section 2. This act is hereby declared to be an emergency	15
measure necessary for the immediate preservation of the public	16
peace, health, and safety. The reason for the necessity is that	17
immediate action is necessary to avoid delays in fiscal year 2002	18
payments to school districts that exceeded the number of permitted	19
calamity days in fiscal year 2001 because of an unforeseen need to	20
close schools to prevent the spread of meningococcal disease.	21
Therefore, this act shall go into immediate effect.	22
