BILL SUMMARY

·        Prohibits the use by law enforcement agencies of traffic law photo-monitoring devices to detect traffic law violations except when a law enforcement officer is present at the location of such a device and issues tickets, citations, or summonses at the general time and general location of the violations.

CONTENT AND OPERATION

Prohibition on the use of traffic law photo-monitoring devices by law enforcement agencies

The bill generally prohibits a municipal, county, or township law enforcement agency, or the State Highway Patrol, from using a traffic law photo-monitoring device to determine compliance with, or to detect a violation of, a municipal ordinance or any state law that governs or regulates the operation of motor vehicles.  The bill provides that this prohibition does not apply when a law enforcement officer is present at the location of a traffic law photo-monitoring device and issues tickets, citations, or summonses at the general time and general location of the traffic law violations.  (R.C. 4511.092(B).)

Definitions

The bill defines a "traffic law photo-monitoring device" as an electronic system consisting of a photographic, video, or electronic camera and a means of sensing the presence of a motor vehicle that automatically produces photographs, videotape, or digital images of the vehicle, its operator, or its license plate (R.C. 4511.092(A)(5)).

COMMENT

The bill contains a definition of "school zone" by cross-reference, but the term is not used in the bill (R.C. 4511.092(A)(4)).
