RESOLUTION SUMMARY

·        Applies to Congress to call a constitutional convention to propose an amendment to the United States Constitution to require balanced budgets for all federal programs and agencies, except in times of war; to give the President the line-item veto power; and to require biennial rather than annual budgets for all federal programs and agencies.

·        Declares the application to be a continuing application.

·        Limits the participation of Ohio delegates in a constitutional convention called pursuant to the application to the subjects contained in the resolution.

·        Requests that if two-thirds (34) of the state legislatures apply to Congress to call a constitutional convention, the convention be called within six months after Congress receives the 34th application.

CONTENT AND OPERATION

Proposed constitutional amendment

The joint resolution, pursuant to Article V of the United States Constitution,[1] applies to Congress to call a constitutional convention for the purpose of proposing to the states for ratification an amendment to the Constitution that would do all of the following:

(1)  Require the President to submit and Congress to adopt only balanced budgets for all federal programs and agencies, except in times of war;

(2)  Grant the President the authority to disapprove any item or items in any bill presented by Congress to the President in addition to the President's authority to veto entire bills;

(3)  Require the President to submit and the Congress to adopt budgets for all federal programs and agencies on a biennial rather than annual basis.

Continuing application

The resolution declares the application to be a continuing application until at least two-thirds of the state legislatures have applied for a constitutional convention or until Congress has proposed an amendment equivalent to the one proposed in this resolution.

Limitation of Ohio's participation

The resolution states that if Congress calls a convention but does not limit it to the subject of the amendment proposed in the resolution, any convention delegates from Ohio are permitted to debate and vote only on the proposed amendment or an equivalent amendment.

Timing of constitutional convention

The resolution requests that if two-thirds (34) of the state legislatures apply to Congress to call a constitutional convention Congress call the convention not later than six months after it receives the 34th application.

Distribution of resolution

The resolution directs the Clerk of the House of Representatives to transmit duly authenticated copies of the resolution to the Speaker and Clerk of the United States House of Representatives, the President Pro Tempore and Secretary of the United States Senate, the members of the Ohio Congressional delegation, the presiding officer of each house of each state legislature in the United States, and the news media of Ohio.

[1] Article V reads in pertinent part:  "The Congress, whenever two thirds of both Houses shall deem it necessary, shall propose Amendments to this Constitution, or, on the Application of the Legislatures of two thirds of the several States, shall call a Convention for proposing Amendments, which, in either Case, shall be valid to all Intents and Purposes, as part of this Constitution, when ratified by the Legislatures of three fourths of the several States, or by Conventions in three fourths thereof, as the one or the other Mode of Ratification may be proposed by the Congress."
