BILL SUMMARY

·         Raises from $10,000 to $25,000 the threshold cost of a municipal park improvement project, beyond which threshold the board of park trustees must cause plans, specifications, and forms of bids to be prepared and distributed among bidders.

CONTENT AND OPERATION

Background--contracts entered into by boards of park trustees

A board of park trustees is charged with managing, controlling, and administering property or funds donated for park purposes to a municipal corporation in accordance with continuing law (R.C. 755.19 and 755.20, not in the bill).  Under continuing law, a board may make contracts for the improvements of the grounds, the erection of the necessary bridges and structures therein, and adopt rules for the protection, care, and government of the parks under its charge (R.C. 755.25, not in the bill).  Continuing law retained in part by the bill requires a board, before entering into any contract for the performance of any work the cost of which exceeds $10,000, to cause plans and specifications and forms of bids to be prepared, and when adopted by the board, to have them printed for distribution among bidders (R.C. 755.29).  Additionally, continuing law prohibits a board from entering into any contract for work or supplies, where the estimated cost thereof exceeds $10,000, without first giving 30 days' notice in one newspaper of general circulation in the municipal corporation that sealed proposals may be received for doing the work or furnishing such materials and supplies.  Continuing law specifies requirements for awarding contracts through competitive sealed proposals.  (R.C. 755.30 to 755.33.)

Operation of the bill

The bill increases the threshold amount, from $10,000 under current law to $25,000, that triggers the requirement that the board, for contracts for the performance of any work the cost of which exceeds the threshold, must cause plans and specifications and forms of bids to be prepared, and when adopted by the board, have them printed for distribution among bidders (R.C. 755.29).  The bill does not increase the amount of the threshold that triggers the newspaper notice requirements.
