BILL SUMMARY

·         Requires a person, when applying for a new or renewal motor vehicle registration, to submit proof of financial responsibility.

CONTENT AND OPERATION

Current law requires a motor vehicle registration application to contain a statement, to be signed by the applicant, that the applicant maintains, or has maintained on the applicant's behalf, proof of financial responsibility at the time of application, and that the applicant will not operate a motor vehicle in this state unless the applicant maintains, with respect to that motor vehicle or the operation of that vehicle, proof of financial responsibility.  The bill requires the registration application to be accompanied by proof of financial responsibility, demonstrated in a manner described in the Financial Responsibility Law.[1]  (R.C. 4503.20(B)(4).)

Current law also provides that if a person purchases a motor vehicle from a licensed motor vehicle dealer or licensed motor vehicle leasing dealer and the dealer agrees to submit the motor vehicle registration application on the purchaser's behalf, the purchaser or lessee must sign the financial responsibility statement described in the preceding paragraph.  The bill requires the purchaser or lessee also to submit proof of financial responsibility at that time.  The dealer must submit the statement and proof of financial responsibility to a deputy registrar.  (R.C. 4503.20(C)(1) and (2).)

[1] R.C. Chapter 4509.  In most cases, financial responsibility is accomplished through a policy of liability insurance; proof of financial responsibility can be demonstrated through the presentation of the applicant's insurance card.
