BILL SUMMARY

·         Prohibits the transfer of ownership or the transfer of location of a C-1, C-2, or C-2x liquor permit in, or to a premises located in, a municipal corporation or the unincorporated area of a township in which the number of that class of permits actually issued exceeds the number of that class of permits allowed to be issued under population quota restrictions.

CONTENT AND OPERATION

Current law authorizes the holder of a C-1 or C-2x liquor permit to sell beer, and the holder of a C-2 permit to sell wine and mixed beverages, for consumption off the premises where sold (R.C. 4303.11, 4303.12, and 4303.121, not in the bill).  Current law generally authorizes one C-1 and one C-2 permit to be issued for each 1,000 population or part of that population in each municipal corporation and the unincorporated area of each township (R.C. 4303.29(B)(2)(a)).  Some municipal corporations and the unincorporated areas of some townships may actually have more of these permits issued within their boundaries than the population quota restriction allows because the Division of Liquor Control does not cancel permits when the population of a political subdivision declines.

The bill requires the Division of Liquor Control to refuse to transfer the ownership, or to transfer the location of, a C-1, C-2, or C-2x liquor permit if the transfer will be in, or to a premises located in, a municipal corporation or the unincorporated area of a township in which the number of that class of permits actually issued exceeds the number of that class of permits allowed to be issued under the population quota restriction described above (R.C. 4303.292(G)).  The bill also removes C-1 and C-2 permits from among those permits whose ownership or location may be transferred from a municipal corporation or the unincorporated area of a township in which the number of permits of that class exceeds the number of such permits allowed to be issued under the population quota restrictions described above to an economic development project located in another municipal corporation or the unincorporated area of another township in which no additional permits of that class may be issued under the population quota restrictions (R.C. 4303.29(B)(2)(b)(i)).
