BILL SUMMARY

·         Prohibits elected officers of political subdivisions and their campaign committees, as well as candidates for elective office of political subdivisions and their campaign committees, from accepting any contributions from an employee of the political subdivision who either is supervised by the public officer, or would be supervised by the candidate if elected to office.

CONTENT AND OPERATION

Currently, elective officers of political subdivisions and candidates for elective office of political subdivisions are prohibited from soliciting contributions from political subdivision employees they supervise; however, accepting such contributions is not prohibited.  The bill prohibits the acceptance of these contributions.

Currently, state elected officers and candidates for state elective office are subject to prohibitions against both soliciting and accepting contributions from state employees that they supervise, or that they would supervise if elected.  The bill makes the same standards that apply to state elected officers and candidates apply to officers and candidates of political subdivisions.

The penalty for knowingly accepting a contribution in violation of the prohibition is a fine equal to three times the amount accepted.  The penalty for unknowingly accepting a contribution in violation of the prohibition is to return to the contributor any amount accepted.  (These penalties apply from continuing law.)
