RESOLUTION SUMMARY

·         Proposes a constitutional amendment to be submitted to the electors at the November 3, 2009 general election to establish a right of the people to enter into private contracts for health care and to prohibit the General Assembly from enacting certain laws related to that right.

CONTENT AND OPERATION

Rights and laws regarding health care

The resolution proposes enactment of a new Section 43 of Article II of the Ohio Constitution to (1) establish that the people have a right to enter into private contracts for health care coverage and services and to purchase private health care coverage, and (2) prohibit the General Assembly from requiring any person to participate in any health care system or plan.  The General Assembly also would be prohibited, from penalizing any person for choosing to obtain or decline health care coverage or for participating in any particular health care system or plan.

Election and effective date

The resolution stipulates that the proposed constitutional amendment will be submitted to the electors at the general election to be held on November 3, 2009.  If approved by a majority of the electors voting on it, the proposed amendment will take effect immediately.
