RESOLUTION SUMMARY

·         Proposes a constitutional amendment to require the General Assembly to enact laws that authorize the submission to the electors of a county of the question of whether to approve casino gaming operations in the county before casino gaming may be conducted in that county.

·         Requires submission of the proposed constitutional amendment to the electors of the state at the May 3, 2010, special election.

CONTENT AND OPERATION

Background

State Issue 3 proposed a constitutional amendment by initiative petition to amend Ohio Constitution, Article XV, § 6 to allow for one casino each in Cincinnati, Cleveland, Columbus, and Toledo "to create new funding for cities, counties, public school districts, law enforcement, the horse racing industry and job training for Ohio's workforce."  The issue was adopted by electors of the state at the general election held on November 3, 2009.  Cuyahoga, Hamilton, and Lucas County voters approved the issue, but Franklin County voters rejected it.

State Issue 3 also requires the General Assembly to pass laws within six months of its effective date to facilitate the operation of the casino gaming provision (Article XV, § 6(C)(10)).

Approval of casino gaming by a county's electors

The proposed constitutional amendment provides that the General Assembly must enact laws that authorize the submission of a question to the electors of a county on whether to approve the operation of casino gaming within the county before casino gaming may be conducted in the county.

Election; effective date

The resolution provides that the proposed constitutional amendment must be submitted to the electors at the special election to be held on May 3, 2010.  If approved by a majority of the electors voting on it, the proposed constitutional amendment will take effect June 1, 2010.
