The Senate Committee adopted amendments that do the following:

1.  Abolish the Holmes County County Court and replace it with the Holmes County Municipal Court effective January 1, 2007, which will be a county operated municipal court.

2.  Create a full-time municipal court judge for the Holmes County Municipal Court to be elected in 2007 for a term beginning on January 1, 2008, with the existing judge of the Holmes County County Court serving as the judge of the Holmes County Municipal Court during 2007.

3.  Designate the Holmes County Clerk of Courts as the clerk of the Holmes County Municipal Court.

4.  Require the Holmes County Prosecuting Attorney to prosecute in the Holmes County Municipal Court all violations of state law arising in Holmes County and authorize the Prosecuting Attorney to enter into agreements with municipal corporations in Holmes County to prosecute violations of municipal ordinances in the Holmes County Municipal Court.

5.  Transfer all proceedings in and employees of the Holmes County County Court to the Holmes County Municipal Court on January 1, 2007.

6.  Add one full-time judge to the Delaware Municipal Court to be elected in 2007.

7.  Add two judges to the General Division of the Summit County Court of Common Pleas to be elected in 2008.

8.  Create the Joint Committee to Study Court Costs and Filing Fees.
