Sub. S.B. 61

126th General Assembly

(H. Civil and Commercial Law)

The Committee made the terminology in the provision specifying the duty of a ski area operator consistent with the terminology in the provision granting immunity to a ski area operator for injury, death, or loss to person or property caused by course, venue, or area conditions that visual inspection should have revealed.  That immunity is subject to the condition that the operator complies with the duty to allow a freestyler or competitor, prior to the use of any portion of a freestyle terrain, a reasonable opportunity to visually inspect (instead of an opportunity to reasonably inspect as in the Senate-passed version) the course, venue, or area of the freestyle terrain.  (R.C. 4169.08(A)(2) and (B)(4).)

The Committee also made technical changes by changing "ski operator" to "ski area operator," which is the term defined in the bill, and by changing "freestyle skier" to "freestyler," which is the term defined in the bill (R.C. 4169.08(A)(2) and (B)(4)).
