A BILL
To enact sections 1753.22 and 3923.72 of the Revised Code relative to coverage for prescription drug services provided by "any willing pharmacies" under policies of sickness and accident insurers and health insuring corporations.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:
Section 1.  That sections 1753.22 and 3923.72 of the Revised Code be enacted to read as follows:
Sec. 1753.22.  (A) Notwithstanding section 3901.71 of the Revised Code, no individual or group health insuring corporation policy, contract, or agreement that includes coverage for prescription drug services provided by participating pharmacies shall exclude coverage of covered drugs dispensed by any nonparticipating pharmacy, including a pharmacy that dispenses drugs through the mail, that is willing to meet the terms and conditions of the pharmacy program of the health insuring corporation or of the network of pharmacies providing prescription drug services under the policy, contract, or agreement.
(B) A violation of this section is an unfair and deceptive act or practice in the business of insurance under sections 3901.19 to 3901.26 of the Revised Code.
Sec. 3923.72.  (A) Notwithstanding section 3901.71 of the Revised Code, no individual or group policy of sickness and accident insurance that includes coverage for prescription drug services provided by participating pharmacies shall exclude coverage of covered drugs dispensed by any nonparticipating pharmacy, including a pharmacy that dispenses drugs through the mail, that is willing to meet the terms and conditions of the pharmacy program of the insurer or of the network of pharmacies providing prescription drug services under the policy.
(B) A violation of this section is an unfair and deceptive act or practice in the business of insurance under sections 3901.19 to 3901.26 of the Revised Code.
