A BILL
To waive the requirement for certain school districts to make up days schools are closed due to flooding and to declare an emergency.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:
Section 1. (A) Notwithstanding sections 3313.48, 3313.481, and 3317.01 of the Revised Code, no school district to which the following conditions apply shall be required to make up any days or hours any of its schools are closed due to flooding during the 2007-2008 school year:
(1) The district was unable to make up the days specified in its contingency plan adopted under division (A) of section 3313.482 of the Revised Code for the schools closed due to flooding because flooding prohibited the district from opening those schools on the days designated in the plan.
(2) The district increased the length of school days, as described in division (C) of section 3313.482 of the Revised Code, to make up the number of days or hours any of its schools were closed in excess of the number permitted by sections 3313.48, 3313.481, and 3317.01 of the Revised Code due to hazardous weather conditions other than flooding or any other calamity described in division (B) of section 3317.01 of the Revised Code.
(B) A school district described in division (A) of this section shall not be considered to have failed to comply with division (B) of section 3317.01 of the Revised Code during the 2007-2008 school year for purposes of receiving state payments under Chapter 3317. of the Revised Code in fiscal year 2009.
Section 2. This act is hereby declared to be an emergency measure necessary for the immediate preservation of the public peace, health, and safety. The reason for such necessity is to ensure the uninterrupted payment of state funds to school districts where unforeseen flooding has prevented the districts from implementing their contingency plans for making up excess calamity days. Therefore, this act shall go into immediate effect.
