A BILL
To enact section 4513.264 of the Revised Code to require all buses purchased, leased, rented, or chartered by universities and colleges to transport students or employees to be equipped with occupant restraining devices for all passengers, to permit buses that currently are owned by universities and colleges and are not equipped with occupant restraining devices for all passengers to shuttle students or employees indefinitely, and to permit such buses to transport students or employees on trips other than shuttle trips for a period of three years before such buses are required to be equipped with occupant restraining devices for all passengers.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:
Section 1. That section 4513.264 of the Revised Code be enacted to read as follows:
Sec. 4513.264.  (A) As used in this section:
(1) "Occupant restraining device" has the same meaning as in section 4513.263 of the Revised Code.
(2) "Shuttle" means the transport in a bus of students or employees of a university or college, at a speed not exceeding forty-five miles per hour, to a site that is located not greater than ten miles from the geographic center of the university or college or on a round trip of not more than twenty miles as measured from the geographic center of the university or college.
(3) "University or college" has the same meaning as in section 4503.51 of the Revised Code.
(B) No university or college shall purchase, lease, rent, or charter a bus and use that bus to transport students or employees of that university or college unless the bus is equipped with an occupant restraining device for every passenger seating position.
(C)(1) A university or college that, on the effective date of this section, owns a bus that is not equipped with an occupant restraining device for every passenger seating position, may use that bus to shuttle students or employees of that university or college or, subject to division (C)(2) of this section, to transport students or employees of that university or college for trips other than shuttle trips.
(2) A university or college that, on the effective date of this section, owns a bus that is not equipped with an occupant restraining device for every passenger seating position, may use that bus to transport students or employees of that university or college for trips other than shuttle trips for a period of three years commencing with the effective date of this section. Three years after the effective date of this section, no university or college shall use such a bus to transport students or employees of that university or college for trips other than shuttle trips unless the bus is then equipped with an occupant restraining device for every passenger seating position.
