A BILL
To amend section 4505.01 and to enact section 4505.063 of the Revised Code to apply the motor vehicle certificate of title law to trailers and semitrailers that weigh 4,000 pounds or less and are not farm trailers.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:
Section 1. That section 4505.01 be amended and section 4505.063 of the Revised Code be enacted to read as follows:
Sec. 4505.01.  (A) As used in this chapter:
(1) "Lien" includes, unless the context requires a different meaning, a security interest in a motor vehicle.
(2) "Motor vehicle" includes manufactured homes, mobile homes, recreational vehicles, and trailers and semitrailers, but does not include any trailer or semitrailer used in direct agricultural production whose weight exceeds does not exceed four thousand pounds.
(B) The various certificates, applications, and assignments necessary to provide certificates of title for manufactured homes, mobile homes, recreational vehicles, and those trailers and semitrailers whose weight exceeds four thousand pounds for which a certificate of title is required under this chapter, shall be made upon forms prescribed by the registrar of motor vehicles.
Sec. 4505.063. (A) Notwithstanding section 4505.06 of the Revised Code, if a certificate of title previously has not been issued for a trailer whose weight is four thousand pounds or less, the application for a certificate of title when required by this chapter shall be accompanied by a manufacturer's or importer's certificate; by a sworn statement of ownership; or by a certificate of title, bill of sale, or other evidence of ownership required by law of another state from which the trailer was brought into this state. If such a trailer is assembled from component parts by a person other than a manufacturer, the owner of the trailer is not required to have the trailer inspected by the state highway patrol under section 4505.111 of the Revised Code in order to apply for and obtain a certificate of title for the trailer.
The registrar of motor vehicles, in accordance with Chapter 119. of the Revised Code, shall prescribe the form of the sworn statement of ownership and the types of additional documentation sufficient to establish proof of ownership, including, but not limited to, receipts from the purchase of parts or components, photographs, and affidavits of other persons.
(B) On and after the effective date of this section, if a trailer is assembled from component parts by a person other than a manufacturer and the trailer weighs four thousand pounds or less, the owner of the trailer is not required to have the trailer inspected by the state highway patrol under section 4505.111 of the Revised Code in order to apply for and obtain a certificate of title for the trailer. The owner may apply for a certificate of title for the trailer by complying with any applicable provision of division (A) of this section.
Section 2. That existing section 4505.01 of the Revised Code is hereby repealed.
