A BILL
To enact sections 101.16, 101.161, and 101.162 of the
Revised Code to require conference committee
reports of appropriations and revenue bills to be
made publicly available forty-eight hours prior to
consideration by either house.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:
Section 1. That sections 101.16, 101.161, and 101.162 of the
Revised Code be enacted to read as follows:
Sec. 101.16. As used in sections 101.16 to 101.162 of the
Revised Code:
(A) "Appropriations bill" means any of the following:
(1) The main operating appropriations bill;
(2) The operating appropriations bill for state agencies
supported by motor fuel tax revenue;
(3) The operating appropriations bill or bills for the bureau
of workers' compensation and the industrial commission;
(4) Any bill that makes the principal operating
appropriations for one or more state agencies;
(5) Any bill that primarily contains corrections and
supplemental appropriations to the main operating appropriations
bill;
(6) The main capital appropriations bill;
(7) The bill that primarily contains reappropriations from
previous capital appropriations bills.
(B) "Revenue bill" means any bill raising revenue through
taxes, fees, or similar impositions.
(C) "Publicly available" means the posting of a bill on the
legislature's web site.
Sec. 101.161. (A) Neither house of the general assembly may
consider a report of conference committee of an appropriations or
revenue bill until forty-eight hours after the bill is made
publicly available, excluding Saturdays, Sundays, and legal
holidays, unless the house considering the report of conference
committee is in session on such a day.
(B) The time the report of conference committee is made
publicly available shall be posted on the legislature's web site.
Sec. 101.162. Either house of the general assembly, by a
two-thirds vote of its members, may waive application of section
101.161 of the Revised Code. The clerk of the house that waives
application shall enter the following into the daily journal of
that house with respect to the bill:
"The Legislature waives the forty-eight hour moratorium on
consideration of the report of conference committee required in
section 101.161 of the Revised Code."
