A BILL
To enact section 3959.20 of the Revised Code to
prohibit pharmacy benefit managers that have a
relationship with a retail pharmacy from using
that relationship to the competitive disadvantage
of other retail pharmacies.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:
Section 1. That section 3959.20 of the Revised Code be
enacted to read as follows:
Sec. 3959.20. No pharmacy benefit manager that directly or
indirectly owns or controls, is owned or controlled by, or is
under common ownership or control with, a retail pharmacy shall
use that relationship to the competitive disadvantage of other
retail pharmacies including allowing coverage of covered drugs
dispensed by that retail pharmacy but not by other retail
pharmacies.
For purposes of this section, "pharmacy benefit manager"
means a third party administrator of a prescription drug program.
