A BILL
To enact section 505.708 of the Revised Code to authorize townships to use road equipment and labor resources available to a township to plow certain private roads and driveways either at the expense of the township or for a fee charged to specified persons.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:
Section 1. That section 505.708 of the Revised Code be enacted to read as follows:
Sec. 505.708. (A) A board of township trustees may, by resolution, authorize the use of township equipment and labor, or equipment and labor available to the township for road maintenance under a contract, to plow any of the following roads and driveways within the unincorporated territory of the township:
(1) Private roads essential for providing access to the driveways specified in division (A)(2) of this section;
(2) The driveways of properties owned or inhabited by senior citizens or disabled persons who have incomes at or below two hundred per cent of the federal poverty level; or
(3) The driveways of emergency service areas such as police and fire stations.
(B) The resolution shall specify whether the township will provide plowing services free of charge or whether it will charge a fee to persons specified in division (A)(2) of this section. The resolution shall specify the manner of documenting the allocation of resources to the authority granted by this section. The manner of documentation shall include a requirement for compliance with accounting and reporting requirements under Chapter 117. of the Revised Code. The resolution also shall specify that the level of snowfall shall be at least four inches, or a greater depth as determined by the board of township trustees, before resources may be used for the purposes set forth in this section.
(C) If the resolution specifies that a fee will be charged, the fee shall be an amount necessary to defray the cost of plowing the road or driveway. It shall be deposited in the township general fund.
(D) As used in this section:
(1) "Senior citizen" means an individual who is sixty-five years of age or older.
(2) "Disabled person" means an individual who has a disability as defined in the "Americans with Disabilities Act of 1990," 42 U.S.C. 12102.
