A BILL
To enact section 9.662 of the Revised Code to require
JobsOhio and state agencies offering economic
development assistance to obtain Controlling Board
approval before providing economic development
assistance to a person who, at or near the time of
receiving the assistance, relocates employment
positions from one taxing district to another or
eliminates positions at an existing location.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:
Section 1. That section 9.662 of the Revised Code be enacted
to read as follows:
Sec. 9.662. (A) For the purposes of this section:
(1) "Economic development assistance" means any grant, loan,
guarantee, or job creation or retention tax credit authorized by
the Revised Code.
(2) "Taxing district" means a geographical area in which the
aggregate property tax rate is uniform.
(3) "Economic development agency" means JobsOhio or the
department of development or any other state agency authorized to
award economic development assistance.
(4) "Original location" means the street address from which
the proposed recipient of economic development assistance proposes
to relocate.
(5) "New location" means the street address to which the
proposed recipient of economic development assistance proposes to
relocate.
(6) "Taxing unit" has the same meaning as in section 5705.01
of the Revised Code.
(B) An economic development agency shall obtain controlling
board approval before granting economic development assistance to
any person who, at or near the time of receiving the assistance or
receiving approval to receive the assistance, will relocate or
decrease the payroll of one or more substantially similar
employment positions from one taxing district to another or will
eliminate a position at the person's original location. The
controlling board may not approve such economic development
assistance unless the agency demonstrates, to the satisfaction of
the controlling board, good cause for the relocation or
elimination. Good cause includes, but is not limited to,
substantial enhancements of production or employment, more
efficient utilization of existing infrastructure, enhanced
transportation capacity, or other causes recognized by the
controlling board.
(C) An economic development agency required to obtain
approval of the controlling board under this section shall, before
approval is granted, submit to the controlling board the following
information:
(1) The number of full-time equivalent positions that would
be relocated or eliminated from the original location.
(2) The number of full-time equivalent positions that would
be relocated or gained at the new location.
(3) The change or estimated change in payroll at both the
original and new locations.
(4) An estimate of the decrease in tax revenue that would be
received by each taxing unit encompassing the original location.
(5) An estimate of the increase in tax revenue that would be
received by each taxing unit encompassing the new location.
(6) An explanation of the value or advantages of the
employment relocation or elimination.
