A BILL
To enact section 3901.87 of the Revised Code to
prohibit qualified health plans from providing
coverage for certain abortions.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:
Section 1. That section 3901.87 of the Revised Code be
enacted to read as follows:
Sec. 3901.87. (A) No qualified health plan shall provide
coverage for a nontherapeutic abortion.
(B) As used in this section:
(1) "Nontherapeutic abortion" has the same meaning as in
section 124.85 of the Revised Code.
(2) "Qualified health plan" means any qualified health plan
as defined in section 1301 of the "Patient Protection and
Affordable Care Act," 42 U.S.C. 18021, offered in this state
through an exchange created under that act.
Section 2. (A) It is the purpose of this act to
affirmatively opt out of allowing qualified health plans that
cover nontherapeutic abortions to participate in Exchanges within
this state, as permitted under section 1303 of the "Patient
Protection and Affordable Care Act," 42 U.S.C. 18023.
(B) As used in this section:
(1) "Exchange" means an exchange created under the "Patient
Protection and Affordable Care Act," 42 U.S.C. 18001 et seq.
(2) "Nontherapeutic abortion" has the same meaning as in
section 124.85 of the Revised Code.
