A BILL
To enact section 5501.35 of the Revised Code to require the Department of Transportation to survey each school district, community school, and STEM school regarding transportation safety and alternative transportation options for students living within two miles of school.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:
Section 1. That section 5501.35 of the Revised Code be enacted to read as follows:
Sec. 5501.35.  (A) In coordination with the department of transportation's safe routes to school program, the director of transportation shall create a survey regarding school transportation safety policies and the promotion of nonmotorized transportation options for public school students living within two miles of their school of attendance. Each city, local, exempted village, and joint vocational school district, community school established under Chapter 3314. of the Revised Code, and STEM school established under Chapter 3326. of the Revised Code shall complete and return the survey on or before a date specified by the director. The director shall not require a community or STEM school to complete a survey if no student attending the school lives within two miles of the location of the school. The survey shall state the purpose of the survey and provide information on the safe routes to school program. The survey also may seek the following information:
(1) The location of each school building operated by the district or school and the percentage of the school's students living within two miles of the school;
(2) Whether the district or school has in place any programs relating to transportation safety or the promotion of nonmotorized modes of transportation, such as the use of a crossing guard or participation in a walk to school day;
(3) Whether any safety or traffic study has been completed for the school location, and the results of such a study;
(4) Whether the district or school has surveyed students living within two miles of the school's location regarding modes of transportation to the school;
(5) Any other factors the director determines to be appropriate.
(B) The director shall compile the surveys required in division (A) of this section and publish the findings on the department's web site within ninety days of the effective date of this section.
