A BILL
To enact sections 3701.66 and 3701.661 of the Revised Code to provide for development of educational materials promoting infant safe-sleeping practices and for review of the materials with the parent, guardian, or caregiver of each newborn infant.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:
Section 1.  That sections 3701.66 and 3701.661 of the Revised Code be enacted to read as follows:
Sec. 3701.66.  The department of health shall develop educational materials that promote infant safe-sleeping practices and discuss best practices to reduce the incidence of sudden unexpected infant deaths, including sudden infant death syndrome. In developing the materials, the department shall consider information on these topics made available by the American academy of pediatrics or a successor organization. The materials shall be made available, free of charge, on the internet web site maintained by the department. The department shall revise the materials as necessary to ensure that the information in them is current.
Sec. 3701.661.  (A) As used in this section:
(1) "Freestanding birthing center" has the same meaning as in section 3702.141 of the Revised Code.
(2) "Hospital" means a hospital registered with the department of health under section 3701.07 of the Revised Code that contains a maternity unit licensed under Chapter 3711. of the Revised Code.
(B) Beginning not later than one month after the department of health develops the educational materials described in section 3701.66 of the Revised Code, each hospital and freestanding birthing center shall arrange for a nurse or other appropriate staff member to do both of the following prior to an infant's discharge from the hospital or freestanding birthing center following the infant's birth:
(1) Review, free of charge, the educational materials with the infant's parent, guardian, or other caregiver;
(2) Provide to the infant's parent, guardian, or other caregiver the internet address of the department's web site where the educational materials are available.
(C) The nurse or other staff member who reviews the material with the infant's parent, guardian, or other caregiver shall include in the infant's medical record a notation specifying the date and time that the review occurred.
