A BILL
To enact section 9.27 of the Revised Code to limit
agreements to privatize state property,
facilities, services, or functions.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:
Section 1. That section 9.27 of the Revised Code be enacted
to read as follows:
Sec. 9.27. (A) As used in this section, "privatization
agreement" means any agreement or contract authorized under
section 9.06, sections 126.60 to 126.605, or Chapter 4313. of the
Revised Code, or any other statute enacted by the general
assembly, to do any of the following:
(1) Operate or manage state facilities;
(2) Provide services or undertake functions that have
traditionally been provided by the state;
(3) Sell, convey, lease, or otherwise transfer state
property, facilities, enterprises, or assets for the purpose of
providing services or undertaking functions that have
traditionally been provided by the state.
(B) The state or a state agency may enter into a
privatization agreement only if the agreement meets both of the
following requirements:
(1) The entity with which the agreement is to be made is
located and has its principal place of business in this state.
(2) The agreement does not result in the transfer of jobs or
other employment opportunities to a location outside of this
state.
(C) Any privatization agreement the state or a state agency
enters into that does not meet the requirements of this section is
void.
