A BILL
To enact section 9.318 of the Revised Code to permit
political subdivisions to establish a buy local
Ohio program.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:
Section 1. That section 9.318 of the Revised Code be enacted
to read as follows:
Sec. 9.318. A political subdivision required by law to award
a contract by competitive bidding may adopt an ordinance or
resolution establishing a buy local Ohio program that permits the
political subdivision to choose a bid that is not the lowest bid.
The bid shall be within three per cent of the lowest bid and the
bid shall respond to bid specifications in all material respects
and contain no irregularities or deviations from the
specifications that would affect the amount of the bid or
otherwise give the bidder a competitive advantage. The bidder's
principal place of business shall be within the political
subdivision that is awarding the contract. The bidder's principal
place of business shall be within the county in which the contract
will be performed and the bidder shall have a significant Ohio
economic presence.
As used in this division, "significant Ohio economic
presence" means a bidder that:
(A) Pays required taxes to this state;
(B) Is registered and licensed to do business in this state
with the office of the secretary of state; and
(C) Has ten or more employees based in this state, or
seventy-five per cent or more of its employees based in this
state.
