A BILL
To enact section 5123.193 of the Revised Code
regarding the admission of sex offenders to
residential facilities for persons with
developmental disabilities.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:
Section 1. That section 5123.193 of the Revised Code be
enacted to read as follows:
Sec. 5123.193. (A) Before an individual is admitted as a
resident to a residential facility, the residential facility shall
do both of the following:
(1) Search for the individual's name in the internet-based
sex offender and child-victim offender database established under
division (A)(11) of section 2950.13 of the Revised Code;
(2) If the search results identify the individual as a sex
offender, notify both of the following that the individual may be
admitted to the residential facility:
(a) All local law enforcement agencies with jurisdiction over
the residential facility's location;
(b) Leaders of the community in which the residential
facility is located who the residential facility has reason to
believe would help disseminate to other members of the community
the information about the individual's possible admission.
(B) Each residential facility shall develop a protocol for
establishing and implementing all of the following plans when the
residential facility admits as a resident an individual who is
identified as a sex offender pursuant to the search conducted
under division (A)(1) of this section:
(1) A resident supervision plan that provides for the
residential facility to identify and provide the proper amount of
supervision the individual needs at the residential facility;
(2) A medical emergency plan for the individual and other
residents of the residential facility;
(3) A community engagement plan that includes methods for
both of the following:
(a) Members of the community in which the residential
facility is located to express concerns about the residential
facility's operation;
(b) The residential facility to address the community
members' concerns that are expressed to the residential facility.
(C) A residential facility that admits as a resident an
individual who is identified as a sex offender pursuant to the
search conducted under division (A)(1) of this section shall do
both of the following:
(1) In accordance with the protocol developed under division
(B) of this section, establish and implement the plans specified
in that division;
(2) Subject to division (D) of this section, provide copies
of the plans to the local law enforcement agencies and community
leaders to whom the residential facility provides notice about the
individual pursuant to division (A)(2) of this section.
(D) A residential facility shall redact all medical
information about individuals from the copies of the plans that
the residential facility provides to local law enforcement
agencies and community leaders pursuant to division (C)(2) of this
section.
