A BILL
To enact section 6109.25 of the Revised Code to establish requirements and procedures pertaining to levels of microcystin in public water systems.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:
Section 1. That section 6109.25 of the Revised Code be enacted to read as follows:
Sec. 6109.25.  (A) The director of environmental protection shall adopt rules in accordance with Chapter 119. of the Revised Code establishing both of the following:
(1) A level of microcystin in public water systems that constitutes a threat to the health of persons using the water based on best available science;
(2) Requirements and procedures governing testing of public water systems for microcystin.
(B) A public water system located within the Lake Erie watershed shall conduct testing for microcystin in accordance with rules adopted under division (A) of this section.
(C) If, at any time, water within a public water system contains microcystin at a level exceeding the level established by the director in rules adopted under division (A) of this section, the owner or operator of the public water system shall so notify the applicable board of health. The board of health shall notify users and potential users of the water that the level of microcystin is approaching a level that constitutes a threat to the health of persons using the water.
(D) As used in this section, "board of health" has the same meaning as in section 3734.01 of the Revised Code.
