A JOINT RESOLUTION
| Proposing to enact Section 43 of Article II of the
Constitution of the State of Ohio to prohibit the
General Assembly from enacting certain laws
regarding health care.

BE IT RESOLVED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:
Be it resolved by the General Assembly of the State of Ohio,
three-fifths of the members elected to each house concurring
herein, that there shall be submitted to the electors of the
state, in the manner prescribed by law at the general election to
be held on November 3, 2009, a proposal to enact Section 43 of
Article II of the Constitution of Ohio to read as follows: |
43. The people have the right to enter into private
contracts with health care providers for health care services and
to purchase private health care coverage. The General Assembly may
not require any person to participate in any health care system or
plan, nor may it impose a penalty or fine, of any type, for
choosing to obtain or decline health care coverage or for
participation in any particular health care system or plan. |
If adopted by a majority of the electors voting on this
proposal, Section 43 of Article II of the Constitution of Ohio
takes effect immediately. |
