A CONCURRENT RESOLUTION
To urge the United States Congress and the United States Drug Enforcement Administration to change federal laws, regulations, and policies to allow patients to receive pain medication promptly when transferred to a nursing home from a hospital.


BE IT RESOLVED BY THE HOUSE OF REPRESENTATIVES OF THE STATE OF OHIO
(THE SENATE CONCURRING):


        WHEREAS, Ohio's nursing homes are focused both on serving residents with long-term care needs and on rehabilitating patients coming from hospitals following surgery or other treatment for acute medical conditions before sending them home or to a lower intensity setting; and

        WHEREAS, Patients coming from hospitals often arrive at a nursing home with considerable pain; and

        WHEREAS, Due to federal laws, regulations, and policies, these patients often are prevented from receiving pain medication promptly upon transfer to a nursing home and must wait to receive adequate pain medication while physicians, nurses, and pharmacists comply with federal requirements pertaining to the administration of pain medication in nursing homes, including Schedule II controlled substances; and

       WHEREAS, Physicians, nurses, and pharmacists are equally qualified to manage a patient's pain in a hospital and a nursing home; now therefore be it

        RESOLVED, That we, the members of the 129th General Assembly of the State of Ohio, urge the Congress of the United States and the United States Drug Enforcement Administration to change federal laws, regulations, and policies to allow patients to receive any needed pain medication promptly when transferred to a nursing home following a hospital stay for surgery or other treatment; and be it further

       RESOLVED, That the Clerk of the House of Representatives transmit duly authenticated copies of this resolution to the Administrator of the United States Drug Enforcement Administration, to the Speaker and Clerk of the United States House of Representatives, to the President Pro Tempore and Secretary of the United States Senate, to the members of the Ohio Congressional delegation, and to the news media of Ohio.
