REPRESENTATIVE MEAD
A BILL
To authorize the conveyance of state-owned real estate in Franklin County from
the Department of Mental Retardation and Developmental Disabilities to the
Friendship Baptist Church.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:
Section 1. The Governor is hereby authorized to execute a deed in the name of
the state conveying to the Friendship Baptist Church, and its successors and
assigns, all of the state's right, title, and interest in the following
described real estate:
SITUATE in the State of Ohio, County of Franklin, City of Columbus, in Lot No.
1 of M. L. Sullivants Subdivision of Farming lands, Virginia Military Survey
No. 2668, and being a part of the land conveyed to the State of Ohio by deeds
of record in Deed Book 82, Page 582, and in Deed Book 126, Page 227, Recorders
Office, Franklin County, Ohio, and being more particularly described as
follows:
Beginning for reference at a northeast corner of a 5.513 acre tract, conveyed
to the Friendship Baptist Church by deed of record in Official Record 2118,
Page A19, Recorders Office, Franklin County, Ohio, said reference point being
on the west LA ROW of the Interstate Route 70: thence South 08° 56' 14"
West, a distance of 168.36 feet, and South 45° 21' 29" West, a distance
of 115.79 feet along the southeast line of said 5.513 acre tract to a found
iron pin at the TRUE POINT OF BEGINNING, said beginning reference point being
0.04 ft south and 0.06 ft east of a found iron pin; thence across said State
of Ohio lands the following six courses,
South 55° 28' 04" West, a distance of 47.66 feet to a set iron pin;
thence
North 77° 47' 26" West, a distance of 327.41 feet to a set iron pin;
thence
North 77° 08' 04" West, a distance of 127.97 feet to a set iron pin;
thence
North 17° 36' 46" West, a distance of 365.05 feet to a found iron pin on
the southwest line of said 5.513 acre tract, being South 54° 50' 42"
East, a distance of 142.18 feet from the southwest corner of said 5.513 acre
tract; thence with said southwest line and a southwest line of a 0.131 acre
tract conveyed by deed of record in Official Record 23524, Page E13,
South 54° 50' 42" East, a distance of 727.10 feet to the TRUE POINT OF
BEGINNING, passing found iron pins on corners of said 0.131 acre tract at
141.11 feet and 265.57 feet, containing 2.031 acres more or less, and being
subject however to all legal easements of record.
This description was prepared from surveys made in September 1993 and April
1998 by Robert G. Watts, RPLS #4138. Bearings are based on a bearing of South
54° 35' 57" East for the common line found on the State of Ohio,
Department of Transportation Right-of-Way plan for I-70, Franklin County,
FRA-70-10.36 S, Sheets numbered 251/255 & 11/15. and 252/255 & 12/15, and in
the deed for said 5.513 acre tract. Set iron pins are 5/8"x30" rebars with
yellow plastic caps embossed "Thomas Engr & Surveying".
Section 2. Consideration for the conveyance of the real estate is the purchase
price of twenty thousand dollars.
Section 3. Upon payment of the purchase price, the Auditor of State, with the
assistance of the Attorney General, shall prepare a deed to the real estate.
The deed shall state the consideration. The deed shall be executed by the
Governor in the name of the state, countersigned by the Secretary of State,
sealed with the great seal of the state, presented in the office of the
Auditor of State for recording, and delivered to the Friendship Baptist
Church. The Friendship Baptist Church shall present the deed for recording in
the office of the Franklin County Recorder.
Section 4. The Friendship Baptist Church shall pay the costs of the conveyance
of the real estate.
Section 5. This act shall expire one year after its effective date.
