A BILL
To enact section 3704.12 of the Revised Code to
prohibit the sale of gasoline blended with methyl
tertiary butyl ether (MTBE).
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:
Section 1. That section 3704.12 of the Revised Code be
enacted to read as follows:
Sec. 3704.12. (A) Gasoline blended with methyl tertiary
butyl ether (MTBE) shall not be sold or offered for sale in this
state.
(B) The attorney general, upon the request of the
director of environmental protection, shall bring an action for
injunction in any court of competent jurisdiction against any
person violating or threatening to violate division (A) of this
section. The court has jurisdiction to grant prohibitory and
mandatory injunctive relief.
