A BILL
To enact section 3345.43 of the Revised Code to
require state institutions of higher education to
designate their law enforcement and medical
services units and their threat assessment teams
as "school officials" for purposes
of receiving
student education records under
federal law.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:
Section 1. That section 3345.43 of the Revised Code be
enacted to read as follows:
Sec. 3345.43. (A) As used in this section:
(1) "Mental health professional" has the same meaning as in
section 2305.51 of the Revised Code.
(2) "State institution of higher education" has the same
meaning as in section 3345.011 of the Revised Code.
(B) Each state institution of higher education shall
designate
personnel of its law enforcement unit and its student
medical
services unit, including mental health professionals of
that unit, and personnel assigned to its threat assessment team as
"school officials" for purposes of receiving
student education
records in compliance with the "Family
Educational Rights and
Privacy Act," 20 U.S.C. 1232g. Accordingly, each institution shall
include acknowledgment of that designation in
the notice required
under 20 U.S.C. 1232g(a) and 34 C.F.R 99.7.
