A BILL
To enact section 149.451 of the Revised Code to
prohibit a law enforcement agency from making
available to the general public on the internet a
motor vehicle accident report that contains a
minor's personal information without redacting or
encrypting the personal information.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:
Section 1. That section 149.451 of the Revised Code be
enacted to read as follows:
Sec. 149.451. (A) As used in this section:
(1) "Law enforcement agency" means an organization or unit
made up of law enforcement officers as defined in section 2901.01
of the Revised Code.
(2) "Minor" means a person who is less than eighteen years of
age.
(3) "Personal information" means any of the following
information with regard to a minor: address, electronic mail
address, telephone number, and place of employment.
(B) If a law enforcement agency or a law enforcement officer
or other employee of the agency knows or should know that a motor
vehicle accident report contains personal information with regard
to a minor, the agency or employee shall not make the report
available to the general public on the internet without redacting
or encrypting the personal information.
(C) A law enforcement agency or a law enforcement officer or
other employee of the agency who fails to comply with division (B)
of this section is entitled to immunity from liability on the same
grounds as those defined in division (E)(2) of section 149.45 of
the Revised Code.
(D) This section does not require a law enforcement agency,
or a law enforcement officer or other employee of the agency, to
redact or encrypt personal information from a motor vehicle
accident report that was made available to the general public on
the internet before the effective date of this section.
