A BILL
To prohibit the administration of the assessments
developed by the Partnership for Assessment of
Readiness for College and Careers for the
2014-2015 school year, to prohibit the renewal of
the state's memorandum of understanding with the
Partnership, and to declare an emergency.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:
Section 1. Notwithstanding anything to the contrary in the
Revised Code or in any rule or directive of the State Board of
Education, Superintendent of Public Instruction, or Department of
Education, no school district or public or chartered nonpublic
school shall administer for the 2014-2015 school year any
assessments developed by the Partnership for Assessment of
Readiness for College and Careers. Instead, school districts and
schools shall administer for that school year assessments approved
for each applicable grade level and subject area pursuant to
Section 2 of this act.
Section 2. Not later than November 15, 2014, the Department
of Education shall develop recommendations for the assessments for
each grade level and subject area specified in divisions (A)(1)
and (B)(1) of section 3301.0710 of the Revised Code to be
administered by school districts and public and chartered
nonpublic schools, as applicable, for the 2014-2015 school year.
The Department shall submit the recommendations to the General
Assembly in accordance with section 101.68 of the Revised Code and
shall present the recommendations to the standing committees of
the House of Representatives and the Senate that consider
education legislation at a public hearing. After the
recommendations of the Department are presented to those
committees, the recommendations shall be considered for approval
by the Controlling Board. No assessment recommended by the
Department shall be administered unless it is approved by the
Controlling Board.
Section 3. The State Board of Education, Superintendent of
Public Instruction, and Department of Education shall not take any
steps for the renewal of the state's memorandum of understanding
with the Partnership for Assessment of Readiness for College and
Careers, which was entered into in June 2010, when the term of
that memorandum expires at the end of calendar year 2015.
Section 4. This act is hereby declared to be an emergency
measure necessary for the immediate preservation of the public
peace, health, and safety. The reason for such necessity is to
provide timely approval of state achievement assessments that are
not developed by a multi-state consortium so that they may be
administered for the 2014-2015 school year. Therefore, this act
shall go into immediate effect.
