A CONCURRENT RESOLUTION
| To express the General Assembly's support for the
commercial docket pilot project established by the
Supreme Court.

BE IT RESOLVED BY THE HOUSE OF REPRESENTATIVES OF THE STATE OF OHIO (THE SENATE CONCURRING):
WHEREAS, Commercial litigation is a complex and highly
specialized area of law that requires special expertise on the
part of judges as well as attorneys; and |
WHEREAS, Commercial litigation is often costly and
unpredictable, and many judges lack the knowledge and experience
needed to manage and decide commercial cases efficiently and
reliably; and |
WHEREAS, In 2008, the Supreme Court of Ohio adopted Temporary
Rules of Superintendence authorizing the Chief Justice to
designate up to five counties to participate in a pilot project
creating commercial dockets in the courts of common pleas in those
counties that are overseen by judges with expertise in commercial
litigation; and |
WHEREAS, The courts of common pleas of Cuyahoga, Franklin,
Hamilton, and Lucas counties have been participating successfully
in the pilot project, cases are being handled more expeditiously
and the law is being applied more consistently in those courts
than before the pilot project, and the pilot project has resulted
in a general benefit of the courts, businesses, and people of this
state; and |
WHEREAS, The development and utilization of special dockets
to address commercial issues gives existing and future businesses
located in Ohio more confidence that commercial issues will be
handled by experts in that area of law and will result in greater
certainty and stability for businesses; therefore be it |
RESOLVED, That the General Assembly endorses the commercial
docket pilot project and urges the Supreme Court to expand the
commercial docket program and to make it permanent upon completion
of the pilot project; and be it further |
RESOLVED, That the Clerk of the House of Representatives
transmit duly authenticated copies of this resolution to Chief
Justice Thomas J. Moyer and to the news media of Ohio. |
